BY-LAWS AND CONSTITUTION
SECTION ONE STRUCTURE
The following are the by-laws and constitution of the Fordham University Emergency Medical Service. These by-laws are subdivided first into articles which are further subdivided into sections, subsections and parts.
SECTION TWO PURPOSE
These by-laws and constitution establish the rules and regulations by which the organization shall function. They are a general guideline for the operations of Fordham University’s Emergency Medical Service and should be interpreted for that purpose by its administration.
SECTION THREE PERMANENCY
These by-laws and constitution are permanent and are to be promulgated and adhered to by all those affiliated with the Fordham University Emergency Medical Service.
ARTICLE TWO
THE ORGANIZATION
SECTION ONE THE HISTORY OF FORDHAM UNIVERSITY
Fordham is a university in the Jesuit tradition existing under a charter granted in 1846 by
The New York State Legislature. For a century and a half, Fordham University has served American society by offering instruction in the liberal arts and selected professional areas, on both the undergraduate and graduate levels. What distinguishes Fordham from other universities is the complex of academic heritage and its growth in New York City. Fordham was established under Catholic auspices and has benefited from the services of hundreds of members of the Society of Jesus, a religious order of men who have devoted much of their energy to higher education. Fordham has found that it’s Catholic and Jesuit origins and traditions have provided valuable marks of its distinctiveness and a source of strength. As a consequence, these traditions, religious ideas, perspectives and values hold an important place in the curriculum and in its extra-curriculum activities.
SECTION TWO THE HISTORY OF FORDHAM UNIVERSITY MEDICAL SERVICE
Fordham University Student Emergency Response Group (S.E.R.G.) was begun in 1977
by Bruce Nedleka, a student interested in providing emergency medical service to the Fordham University’s Bronx Rose Hill campus. The group operated as a first-response team providing first aid to students and faculty. Over the years, the organization has grown significantly, both in membership and the level of care it provides. On October 04, 1988, the Fordham University S.E.R.G. was recognized by the New York State Department of Health through the New York City Regional Emergency Medical Services Council as a registered ambulance service. Since that time S.E.R.G., now known as the Fordham University Emergency Medical Service, has operated as a basic life support ambulance service.
SECTION THREE NAME
The name of the organization shall be the Fordham University Emergency Medical Service. Herein, Fordham University Emergency Medical Service shall be
referred to as FUEMS or the organization.
SECTION FOUR CERTIFICATION
The organization is a registered volunteer ambulance service of New York State Department of Health under the emergency medical service program. The organization’s agency code as authorized by the State Department of Health is #7025. This certification needs to be renewed every two years.
SECTION FIVE PURPOSE
The purpose of FUEMS is to provide basic life support emergency medical care to the University community on the Emergency Medical Technician level as specified by the State Department of Health and associated laws of the State of New York in the most efficient manner possible with the resources available.
SECTION SIX GOAL
The goal of the organization is to provide to its patients the highest standard of care possible. This may be accomplished through the use of emergency medical technologies available within the level of care of the organization provides, and a striving to continually enhance the care provided by FUEMS. The organization should serve as a catalyst for thegrowth and development in its membership of community awareness, involvement and volunteerism, leadership and management capabilities.
ARTICLE THREE
JURISDICTION AND DUTY OF THE ORGANIZATION
SECTION ONE JURISDICTION
Fordham University’s Rose Hill campus in the Bronx shall be the specified district to be covered by the organization as stipulated by the State Department of Heath. This district includes all legitimately owned and / or operated properties of Fordham University considered by the University as part of that campus.
SECTION TWO PRIMARY SERVICE AREA
FUEMS is the primary emergency medical service for this district.
SECTION THREE DUTY TO ACT
The organization has both a legal and moral duty to act by providing care in emergency situations. The organization shall respond and provide quality care to any patient requiring medical assistance.
SECTION FOUR COVERAGE
The organization shall operate during the academic year in accordance with the University calendar. Each August, the Director of the organization and the Director of Health Services for the University shall define such coverage. The organization shall assess the need for coverage at other times and seek to provide such coverage, if appropriate.
ARTICLE FOUR
ORGANIZATIONAL DIVISION
The organization shall be divided into administrative and medical operations. This distinction is made to acknowledge the two major functions within the organization, medical duties and responsibilities and administrative duties and responsibilities. Officers of similar rank within the medical and administrative staffs have equal authority.
SECTION ONE MEDICAL OPERATIONS
The medical division of the organization is primarily responsible for the provision of the emergency medical care to the district as specified herein.
SECTION TWO ADMINISTRATIVE OPERATIONS
The administrative division of the organization is primarily responsible for its overall administration.

SUBSECTION A FORDHAM UNIVERSITY ADMINISTRATION
PART ONE THE PRESIDENT
The President, as the Chief Executive Officer of the University, oversees all University functions.
PART TWO THE VICE PRESIDENT FOR STUDENT AFFAIRS
The Vice President for Student Affairs is the executive of the University within whose area the organization functions. Designated by the President to administer student affairs, this executive shall have authority over the organization.
PART THREE DIRECTOR OF HEALTH SERVICES
The Director of Health Services, shall serve as the administration’s supervisor responsible for the overall operation of the organization, and as such is the organization’s immediate supervisor within the University administration.
SUBSECTION B ORGANIZATIONAL CHAIN OF COMMAND
PART ONE THE DIRECTOR
The Director is the chief administrator of the organization and is responsible for all administrative matters related to FUEMS This includes but is not limited to being the chief liaison officer between the organization and all other agencies, being the chief spokesperson for the organization, and being responsible for setting administrative policy for the organization. The Director shall act in coordination with the Chief of Operations to ensure that each is aware of the other’s needs. The Director must be a New York State certified Emergency Medical Technician for at least one year and an officer of FUEMS prior to seeking this position. The Director shall report directly to the Director of Health Services on matters relating to FUEMS
PART TWO THE ASSOCIATE DIRECTOR
The Associate Director is the second ranking administrative officer of the organization. The Associate Director’s primary function is to complete all the administrative tasks delegated by the Director. The Associate Director shall oversee the financial business for the organization under the supervision of the Director. The Associate Director must be a New York State certified Emergency Medical Technician and an officer or active member of the Day Staff prior to seeking this position. In the absence of the Director, the Associate Director shall assume all of the Director’s duties and responsibilities.
PART THREE THE EXECUTIVES
The Executive position is the third ranking administrative officer of the organization. There shall be three Executives whose primary function is to complete all the administrative tasks assigned by the Director or the Associate Director. The Executives must be a New York State certified Emergency Medial Technician or in training to become an Emergency Medical Technician prior to seeking this position. In the absence of the Director and the Associate Director, the Executive with highest medical ranking shall assume all of their duties and responsibilities.
PART FOUR THE CHIEF OF OPERATIONS
The Chief of Operations of the organization is the chief line officer of the organization and in that capacity is the chief medical officer of the district. The Chief of Operations shall act in coordination with the Director to ensure that each is aware of the other’s needs. The Chief of Operations shall be responsible for ensuring that every patient treated by FUEMS receives the highest standard of care possible. The Chief of Operations is also responsible for ensuring that all subordinates receive and maintain adequate emergency medical training. The Chief of Operations must be a New York State certified Emergency Medical Technician for at least one year and an officer of FUEMS prior to seeking this position. The Chief of Operations shall report directly to the Director of Health Services on matters relating to FUEMS.
PART FIVE THE CAPTAIN
The Captain is the second ranking line officer of the organization and in that capacity is the second ranking medical officer of the district. The Captain is responsible for reporting to the Chief of Operations with regard to all FUEMS matters and is responsible for maintenance of the organization’s vehicles and ensuring that they remains in working order. The Captain is the direct liaison officer with The Office of Intercampus Transportation. The Captain must be a New York State certified Emergency Medical Technician and an officer or active member of the day staff prior to seeking this position. Additionally, the Captain must be a driver and a driver trainer. In the absence of the Chief the Captain shall assume all of their duties and responsibilities.
PART SIX THE FIRST LIEUTENANT
The First Lieutenant is the third ranking line officer of the organization and in that capacity the third ranking medical officer of the district. The First Lieutenant is responsible for reporting to the Captain with regard to all FUEMS matters and must be a New York State certified Emergency Medical Technician prior to seeking this position. In the absence of the Chief of Operations and the Captain, the First Lieutenant shall assume all of their respective duties and responsibilities. As a lieutenant, the First Lieutenant is bound by such duties and responsibilities as listed below in part seven. The First Lieutenant is an honorary position appointed by the Chief of Operations.
PART SEVEN THE SECOND LIEUTENANTS
There will be two Second Lieutenants, one of who must serve as the Second Lieutenant in Charge of Training. The Second Lieutenants, with the exception of the Second Lieutenant in Charge of Training, shall command regular tours of duty as defined by the Chief of Operations. The lieutenants are responsible for reporting to the First Lieutenant on all FUEMS matters. All Lieutenants must be New York certified Emergency Medical Technicians or presently enrolled in an Emergency Medical Technician class prior to their seeking this position. In the absence of the Chief of Operations, Captain, and First Lieutenant, the Second Lieutenant with officer seniority shall assume all of their respective duties and responsibilities. In the event that two Lieutenants have equal officer seniority, the officer with Emergency Technician seniority shall assume all these responsibilities. In the event that two Lieutenants have equal member seniority, the Chief of Operations shall distinguish the authority of each Lieutenant. The Second Lieutenant in Charge of Training shall maintain current written data pertaining to all member’s certifications and qualifications and shall develop, organized, and implement the training agenda for the organization, under direct supervision of the Chief of Operations. The Second Lieutenant in Charge of Training shall have the resources available to accomplish this task and in matters pertaining to the development of said agenda shall have authority, with consent of the Chief of Operations to implement it.
PART EIGHT HEAD OF DAY STAFF
The Head of Day Staff is a position designated to be filled by an active member of the organization. After the election of the new officer staff on the first Tuesday in April, the Head of Day Staff will be appointed by the Director and the Chief of Medical Operations. The Head of Day Staff must be a NYS certified Emergency Medical Technician at the time of appointment. The Head of Day Staff will have the same voting rights as officers, and will be required to attend all joint staff meetings and officer trainings as the official representative of the Day Staff. The Head of Day Staff will be responsible for formulating and implementing, with the consultation and the approval of both the Director and Chief of Medical Operations, new procedures for the mobilization of the Officer and support staff. The Head of Day Staff will also be responsible for conducting monthly meetings with the entire Day Staff. In the absence of the Head of Day Staff, the Chief of Operations will assume all roles associated with the position.
PART NINE GENERAL MEMBERSHIP
Any member of the Fordham University community, as defined by the Dean of Student Life, may join FUEMS. All members must be trained in first aid and Cardio-Pulmonary Resuscitation Techniques as soon as possible after joining the organization. Members must be so trained prior to responding to any emergency calls. Members shall be considered probationary members for one month after joining. During the probationary period members must obtain the necessary certifications as outlined above and undergo any other training deemed necessary by the Chief of Operations. Probationary members must also demonstrate a genuine interest in the organization and its goals. After the probationary period has ended, the Director, upon recommendation of the Chief, shall place the probationary member on active member status. All members must be students in good standing as defined by the University Student Handbook. Students who are not in academic good standing must request permission from the Dean of Student Life to retain membership in the organization.
PART TEN ACTIVE DAY STAFFMEMBERS
Active Day Staff members are only named as such upon their clearance by the Chief of Operations as a Crew Chief or a driver, and their subsequent support in responding to day calls. In order to maintain active day staff members status, they must meet all the criteria of an active member and must consistently go on day calls. The administrative staff, along with the officer in charge of QA/QI, will keep accurate records of the members’ participation. Active day staff member status will be determined by the Director and the Chief of Medical Operations for all purposes concerning elections and appointments.
PART ELEVEN ACTIVE MEMBERS
Active members are only named as such upon their clearance for ambulance attendance. Clearance is determined by the Director upon the recommendation of the Chief of Operations. In order to maintain active member status, members are required to participate in two shifts per month during the academic year. The administrative staff will determine a member’s active status by keeping detailed records of members’ participation. Exceptions to this rule may be granted by the Director with the consultation of the Chief of Operations if such an extraordinary circumstance should arise. As an active member, one has the privilege of voting in organized elections and may hold office in the organization. Voting privileges are extended to active members on probation but revoked from active members on suspension.
SUBSECTION C MEDICAL CHAIN OF COMMAND FOR ALL EMERGENCIES
PART ONE MEDICAL AUTHORITY AT THE SCENE
Medical authority within the organization at the scene of any emergency to which FUEMS response shall follow this general pattern: Chief of Operations, Director, Captain, Associate Director, First Lieutenant, Second Lieutenants, Executives, and General Membership.
PART TWO MEDICAL AUTHORITY FOR INDIVIDUAL PATIENT CARE
Medical chain of command for individual patient care shall be based on medical seniority according to New York State Department of Health Standards, regardless of the chains of command outlined in this article. In most instances medical chain of command for individual patient care will follow Emergency Medical Technician seniority.
SUBSECTION D NEW YORK STATE DEPARTMENT OF HEALTH
The organization is responsible for adhering to state health standards, policies and memoranda with regard to emergency medical services. Inquiries regarding FUEMS certification or requirements as a state registered emergency medical service must be referred to the New York State Department of Health Emergency Medical Services Program Office in Albany.
SUBSECTION E HONORARY MEMBERSHIP
PART ONE HONORARY CHIEF
Honorary chiefs are individuals who have shown exemplary dedication and commitment to FUEMS. Once the Director and the Chief of Operations make a selection, they must notify these individuals in appropriate written form. This position is strictly honorary; honorary chiefs are not active voting members of the organization.
PART TWO LIFE MEMBERSHIP
Life members are individuals who have demonstrated exemplary and extraordinary commitment and dedication to the organization as of October 4th, 1988. The Director and Chief of Operations of FUEMS must notify these individuals of this position in appropriate written form. Life members are not voting members of the organization nor do they hold officer rank in the organization. However, they may respond to emergency medical calls in coordination with the organization provided that they maintain current certification as New York State Emergency Medical Technicians.
SECTION TWO ADVISORS
SUBSECTION A FUEMS ADVISORY BOARD
PART ONE STRUCTURE
FUEMS shall have an Advisory Board consisting of the Director of Health Services for the University, The Dean of Student Life, The Dean of Student Services, the AVP of University Security, The Director of Intercampus Transportation, The FUEMS Chaplain, The Medical Director of FUEMS, past Directors and Chiefs, the entire FUEMS officer staff, and all other individuals selected by the Director and Chief of Operations.
PART TWO PURPOSE
The purpose of the Advisory Board shall be to advise the organization with respect to administrative policy making.
PART THREE MEETINGS
The Board shall meet two times yearly as scheduled by the Director of FUEMS. Emergency meetings may be scheduled upon recommendation of any member. One month notice of each non-emergency meeting must be given to each member of the Board by the Director as to the date, time, location, and purpose of the meeting. In the case of emergency meeting the Director shall notify every member of the board by whatever means possible.
SUBSECTION B MEDICAL DIRECTOR
FUEMS shall have a New York State Board certified medical doctor or D.O. act as Medical Director for the organization. The Medical Director is selected by the Chief of Medical Operations along with the Director of FUEMS and the Director of Health Services. The Medical Director shall advise the organization on matters regarding the provision of the emergency medical care, be available to answer inquiries that organization may have regarding emergency medical procedures, and meet with the Chief of Operations of the organization.
ARTICLE SIX
ADMINISTRATIVE OPERATIONS
The Administrative Operations of the organization are divided into six categories: personnel, budget, development, education, public relations, and legal issues. This article serves as a general overview of the administrative functions of the organization. It should not be considered to be the sole guideline for FUEMS administrative policy making. The Administrative Staff officers of the organization are the Director, the Associate Director, and the Executives. The Administrative Staff shall be referred to as the staff for the remainder of this Article.
SECTION ONE PERSONNEL
SUBSECTION A RECRUITMENT
The staff shall be responsible for the planning and implementation of all recruitment operations for the organization. Due provisions must be made to ensure that the organization maintains a sufficient number of qualified personnel.
SUBSECTION B ORIENTATION
The staff shall be responsible for orientating new and prospective members to all policies, procedures and functions of the organization. It shall provide this orientation in written form and whatever other forms are necessary.
SUBSECTION C ORGANIZATION AND COMMUNITY DEVELOPMENT
The staff shall be responsible for ensuring that the Fordham University community is kept informed of all matters relating to the provisions by FUEMS of emergency medical care. The staff shall also develop and improve relations with all of the agencies of the University. The staff shall keep the membership informed of all FUEMS matters. The staff must be aware of and meet the needs of the membership regarding the organization. The staff should take efforts to preserve and maintain the history of the organization through documentation and statistical record keeping.
SUBSECTION D TRANSITION
The staff shall be responsible for ensuring for the smooth transition of all officer positions of FUEMS at the appropriate times. The staff shall prepare all potential officers for the position each may seek. Each March, the staff should hold a seminar for all prospective officers who must include but not be limited to an intense review of each officer position and the duties and responsibilities pertaining to it. When unforeseen transitions occur, the Director shall develop and implement all appropriate plans.
SECTION TWO BUDGET
SUBSECTION A PLANNING AND COORDINATION
The staff shall be responsible for planning and coordinating all budgetary matters relating to FUEMS. Due provisions must be made to ensure that all needed supplies and equipment, training costs, development funds and other vital areas are included in the budget planning process.
SUBSECTION B APPROPRIATIONS, PURCHASING, AND EXPENDITURES
The staff shall be responsible for ascertaining and following all policies and procedures for appropriation, purchases and expenditures of any agency issuing a budget to the organization.
SECTION THREE DEVELOPMENT
The organization should continually search out development sources that will enable it to further increase the standard of care it provides to its patients. Funds that are raised or public relations that are established through development should be documented and monitored by the staff.
SUBSECTION A FUNDRAISING
The Director shall plan and implement any necessary fundraising efforts, providing that they have been approved through the Vice President for University Relations or by the Director of Health Services. Fundraising should be an ongoing effort.
SUBSECTION B RESOURCES
The staff in close collaboration with and with the approval of the Vice President of University Relations or by the Director of Health Services shall be responsible for researching and compiling a list of potential donor resources, formulating a strategy for tapping those resources and cross-checking this information with the appropriate agencies. Upon completion of these steps the Director shall present to the appropriate individual or agency a formal request for moneys to be donated to the organization.
SECTION 4 EDUCATION
SUBSECTION A COMMUNITY AWARENESS PROGRAMMING
The staff shall be responsible for planning and implement in community awareness programs that include but should not be limited to publicizing and explaining the nature and scope of the organization’s service, whom to notify in the event of an emergency, the availability of Firs Aid, Cardio-Pulmonary Resuscitation, and Emergency Medical Technician classes, and offering other forms of education to the community, the staff shall be available to answer question regarding the services provided by FUEMS.
SUBSECTION B ORIENTATION
In the interest of the safety and well being of the entire community, the staff shall endeavor to orient all new members of the Fordham University community to the services available to them through the organization. Particular efforts in this area should be directed towards new students and employees of the University.
SECTION FIVE PUBLIC RELATIONS
SUBSECTION A INTRA-UNIVERSITY RELATIONS
Due to necessary encounters of the organization with members of the Fordham community, FUEMS should make them aware of the services available to them through the organization. Particular efforts in this area should be directed towards the students and employees of the University.
SUBSECTION B EXTRA-UNIVERSITY RELATIONS
Due to the necessary encounters of the organization with certain external agencies, it is essential that the staff maintain sound relations with them. Such agencies include but are not limited to hospitals, the Fire Department of New York, the New York City Police Department, the New York State Department of Health and the New York City Regional Emergency Medical Service Council.
SECTION SIX LEGAL ISSUES
Due to the stringent requirements placed on registered ambulance services by the state it is necessary for the staff to identify and appropriately respond to the legal issues that pertain to FUEMS.
SUBSECTION A PAPERWORK
There are multiple forms of documentation that the staff must maintain at all times. Forms of documentation include personnel files which will consist of a release form, application, Hepatitis B form, copies of all certification, sexual harassment policy, letters of reprimand, and driver and crew chief clearance forms. Vehicular accident report forms as well as incident reports shall also be maintained by the staff.
SUBSECTION B OTHER OFFICERS OF THE UNIVERSITY
PART ONE FINANCIAL VICE PRESIDENT AND TREASURER
The Financial Vice President and Treasurer is the individual responsible for the insuring of the organization and in all pertinent respects should be contacted by the staff. All matters concerning injuries and accidents as well as workman’s compensation for same should be addressed to this office, via the Director of Health Services.
PART TWO GENERAL COUNSEL
The General Counsel is responsible for handling all legal matters of the University and is available for consultation and assistance as appropriate, through the Director of Health Services.
ARTICLE SEVEN
MEDICAL OPERATIONS
The Medical Operations of the organization are divided into five categories: emergency medical operations, vehicles, training QA/QI, and supplies. This article serves as a general overview of the medical functions of the organization. It should not be construed to be the sole guidelines for FUEMS medical policy making. The medical line officers who comprise the medical staff, referred to in the remainder of this article as the staff, are the Chief of Operations, Captain, First Lieutenant and the Second Lieutenants.
SECTION ONE PERSONNEL
SUBSECTION A MEMBERSHIP
The staff shall be responsible for orienting new members to all emergency medical policies, procedures, protocols. It shall provide orientation in written form and, when necessary, with practical demonstration.
SUBSECTION B THE MEDICAL DIRECTOR
The Chief of Operations shall be the direct liaison officer with the Medical Director and in that capacity shall coordinate all written and verbal communication with the Medical Director. The staff should address any and all inquires to the Chief of Operations who will present these to the Medical Director.
SECTION TWO EMERGENCY MEDICAL OPERATIONS
Emergency medical operations are the primary functionof the organization. They are defined as the community’s request for and the organization’s response to medical emergencies.
SUBSECTION A RESPONSE
The staff is responsible for safe and expeditious response to emergencies. This involves providing adequate personnel to enable proper delivery of medical care, maintaining equipment necessary for such care, and providing whatever care is required. Response may also include transportation to a medical facility. FUEMS guarantees return transportation to the district of any patient who has been transported to a medical facility by the organization. The Chief of Operations may make exception to this only in situations wherein return transportation will interfere with emergency medical operations of the organization.
SUBSECTION B MEMBER OF SERVICE CALLS
M.O.S. is an abbreviation for those individuals who are members of FUEMS. Due provisions are to be made to care for the members of the service who require special medical consideration. When such provisions are required, the Chief of Operations shall have full authority to make exception to standard operating procedures that may inhibit such care.
SUBSECTION C COVERAGE
The staff is responsible for providing all emergency medical coverage required of the organization. Coverage that is not required by the organization but is requested by a particular agency should be addressed to the Chief of Operations for consideration. In approving coverage outside the district, the Chief of Operations must consider the ramifications of leaving the district without proper medical protection. Coverage out of the district must receive final approval by the Director in coordination with the Director of Health Services.
SECTION THREE VEHICLE(S)
The organization must have at least one ambulance vehicle to provide coverage. The captain is responsible for the maintenance of the vehicle(s). The Chief of Operations in consultation with the Captain must first approve any member who drives a vehicle operated by the organization as a driver, after sufficient training. Due provisions must be made to ensure that the vehicle(s) are in working order and are capable of providing the emergency medical care expected of the organization.
SECTION FIVE TRAINING
SUBSECTION A FIRST-AID AND CARDIO-PULMONARY RESUSCITATION TECHNIQUES
The staff is responsible for ensuring that every member is trained in First Aid and Cardio-Pulmonary Resuscitation techniques.
SUBSECTION B EMERGENCY MEDICAL TECHNICIAN
The staff is responsible for ensuring that there are always at least ten New York State certified Emergency Medical Technicians at all times.
SUBSECTION C CREATION OF TRAINING INCENTIVES
The staff should encourage all members to seek certification as Emergency Medical Technicians and should provide the incentives for such training.
SUBSECTION D DRIVER TRAINING
The staff should encourage drivers to seek certification as emergency vehicle operators.
SUBSECTION E SECOND LIEUTENANT IN CHARGED OF TRAINING
The Second Lieutenant in Charge of Training is responsible for ensuring that members maintain emergency medical certifications. He/she is also responsible for ensuring that all members are qualified to provide the standard of care expected of the organization by the community.
SUBSECTION F EDUCATION
Due to the constantly changing nature of the emergency medical care that the organization provides to the community, it is essential that in regard to emergency medical matters the organization is up-to-date. It is the responsibility of this staff to maintain an adequate level of emergency medical knowledge through current education for all members of FUEMS
SECTION SIX LEGAL ISSUES
SUBSECTION A CHIEF OF OPERATIONS
The Chief of Operations is the individual ultimately responsible and accountable for the provision of emergency medical care whenever it is provide by FUEMS. The Chief of Operations is also solely accountable for all medical operations of the organization and in accepting this position accepts the accompanying responsibilities.
SUBSECTION B APPLICABLE LAWS
The organization shall adhere to all New York State Law applicable to registered ambulance services. These laws include but are not limited to medical protocols, Public Health Laws and Codes, and Department of Health Regulations, Abandoned Infant Protection Act, Requirements for Reporting Suspected child abuse or Maltreatment.
ARTICLE EIGHT
POLICY DEFINITIONS
To ensure that the Organization maintains a certain standard of care, there must be specified and detailed policies to guarantee such care.
SECTION ONE STANDARD OPERATING PROCEDURES (SOP’S)
The Organization shall follow a set of SOP’s which are policy statements developed to provide a detailed guideline for daily operations and which can be updated at any time by the Director in the case of Administrative Policy making and the Chief of Operations in the case of medical policy making. The Director and the Chief of Operations should cross reference procedural changes with each other. These SOP’s must be reviewed once a year by the Director and the Chief of Operations and must be updated as necessary.
SECTION TWO POLICY STATEMENTS
Policy statements identify the official policy stance of the Organization on a given issue. Only the Director and the Chief of Operations may authorize a policy statement. Such statements should be indicated in written form as such and should be distributed to the individuals and or agencies to which they pertain. Each policy statement, once promulgated, comprises an update to the SOP’s, the most recently dated order is to be followed. All other forms of correspondence within the Organization and University Agencies are to be considered memoranda to be written in standard, acceptable memoranda form.
ARTICLE NINE
CODE OF CONDUCT
The code of conduct serves as a control for Organizational activities. It is to be accurately promulgated to the membership so that each member has a full knowledge of how they are expected to conduct themselves when representing the Organization. To ensure that the highest quality care is delivered to each patient treated by the Organization, the variouspolicies set forth by the Administration of FUEMS and by the individual Officers of the Organization must be adhered to by each member at all times.
SECTION ONE PROFESSIONALISM
SUBSECTION A PATIENT CONCERNS
Concern for the patient is the foremost responsibility of each member. Care to the patient is to be provided in the most professional fashion. Each patient is to be treated with the utmost dignity and respect by each member of the Organization. All members of FUEMS are required to render assistance to a patient when requested to do so.
SUBSECTION B APPEARANCE
When acting as an agent of the Organization, members are to present themselves in a polite and courteous manner. Members should be clean and neatly attired when responding to an emergency call. The Officer in Charge of the call shall determine and be accountable for what constitutes proper appearance.
SUBSECTION C UNIFORMS
The Director and the Chief of Operations may implement a uniform policy to further the Organization goal of providing more professional care to the community. A consensus of the Organization should be obtained prior to implementing any such policy. For any uniform policy to be successful, all members must adhere to its requirements.
SUBSECTION D CONFIDENTIALITY
At no time is any information regarding any emergency operation to be discussed or debriefed to any person or persons who are not affiliated with FUEMS. This should occur only in reviewing calls for drill or training purposes. Any type of casual discussion of emergency calls should be avoided. Affiliation with the Organization should be defined by the Director and the Chief of Operations.
SUBSECTION E ALCOHOL AND OTHER CONTROLLED SUBSTANCES
At no time is any member of the organization to be in an impaired or intoxicated state while acting as an agent of FUEMS. The officer in charge shall determine and be strictly accountable for what constitutes a state of impairment or intoxication. Members in such states should never be permitted to participate, willingly or not, in any function of the organization.
SUBSECTION F DISCRIMINATION
At no time shall the organization discriminate against any patient or member for the reasons of race, age, creed, sex or ethnic origin.
SECTION TWO ADJUDICATION PROCEDURES
SUBSECTION A GRIEVANCES
Any member who has a personal grievance relating to the organization in any way should make all attempts to resolve it with the appropriate member or officer involved. Non-personnel grievances should be addressed to an officer as soon as possible. If a grievance remains unresolved it should be brought to the attention of the Director or the Chief of Operations immediately. Any member of the organization may, however, at any time present a grievance to the attention of the Director or the Chief of Operations.
SUBSECTION B ADJUDICATION PROCESS
Upon receipt of a grievance, the Director and the Chief of Operations will review such concern, taking into consideration all relevant information, and rendering an appropriate decision on the matter.
SUBSECTION C APPEAL PROCESS
Should the member who filed the grievance be dissatisfied with the decision of the Director and the Chief of Operations, he/she may appeal the decision to an Adjudication Board comprised of the Associate Director, the Captain, the Director, the Chief of Operations, and one other Officer chosen by the Chief of Operations and the Director. This board shall review the case and render a decision by vote.
SECTION THREE DISCIPLINE
To maintain a level of discipline within the organization, and to ensure adherence to the various policies set forth herein, certain disciplinary measures are available for use by the Officers of the organization.
SUBSECTION A PROBATION
Any member of the organization may be placed on probation, with prior consent of the Director and Chief of Operations, by any Officer in appropriate written form. Reasons for probation may include, but are not limited to, failure to follow the policies of the organization or the direct orders of an Officer.
PART ONE APPEALS PROCESS FOR PROBATION
There are no appeals for probation judgments.
SUBSECTION B SUSPENSION
Any member of the organization may be suspended, with prior consent of the Director and Chief of Operations, by any Officer in appropriate written form. Reasons forsuspension may include, but are not limited to, more than two probation judgments, blatant and repeated disregard for policy or direct orders of an Officer, or posing a potential life hazard to himself/herself and others. The Director or Chief of Operations will consult the Director of Health Services when placing any member on suspension status.
PART ONE TERMS OF SUSPENSION
A member placed on suspension may not respond to emergency calls, participate in organizational functions, or exercise any privileges of membership, for a period not to exceed 14 days.
PART TWO APPEAL PROCESS FOR SUSPENSION
The appeal process for suspensions follows the appeal process for grievances. However, when a member of the Adjudication Board is the suspended Officer, the next ranking Officer shall replace him/her in hearing the case. The suspending Officer shall be permitted to participate in the hearing but shall not vote.
SUBSECTION C DISMISSAL
Any member of the organization may be dismissed by the Director or Chief of Operations, after conferring with the Officer Staff and the Director of Health Services before rendering such a decision. Reasons for dismissal may include more than two suspension judgments, blatant and repeated disregard for policy or direct orders from an Officer or posing a direct life hazard to himself/herself or others. A dismissed member will not be considered for membership in the organization until 12 months have passed, at which time he/she may re-apply. The reapplication may be denied without explanation.
SUBSECTION D APPEAL PROCESS FOR DISMISSAL
Appeals for dismissal judgments follow the appeal procedure for suspension judgments.
SUBSECTION E DISCIPLINARY PROCEDURES FOR THE DIRECTOR AND CHIEF OF OPERATIONS
Since the Director and the Chief of Operations are the highest ranking officers of FUEMS, only the Director of Health Services may place the Director or Chief of Operations on probation, suspension, or dismiss the Director or Chief of Operations from the Organization. Appeals for such decisions follow University adjudication procedures for disciplinary hearings and appeals as set forth in the University Student Handbook.
ARTICLE TEN
ELECTIONS AND MEETINGS
SECTION ONE ELIGIBILITY
Any active member meeting the criteria established for an Officer position may run for any Office. Any member seeking elected positions must submit his/her name to the Director no later than three weeks prior to an election. The Director will prepare a ballot that includes the names and positions sought of those running for elected office.
SECTION TWO ELECTIVE PROCESS
The election of Officers shall take place on the first Tuesday of April each year. Each Officer, with the exception of the Director and Chief of Operations, is elected by the active membership of the Organization through majority vote by a sealed ballot. The Director shall distribute one ballot to each active member. Each member will cast a vote and seal it in a plain white envelope to be provided by the Director. The ballot shall be opened and counted aloud by the Director in the presence of the Chief of Operations and any member wishing to witness the counting of the ballots.
SUBSECTION A CERTIFICATION OF BALLOTS
The Director will certify the winners of the election by verbally informing each of the election results as soon as possible.
SUBSECTION B RECOUNTING OF ELECTION BALLOTS
A recount of the ballots may be made upon the request of any candidate in the election. A recount must be witnessed by that candidate and 2 non-candidate members. No more than 2 recounts may be held for all ballots.
SUBSECTION C IN THE CASE OF A TIE
If voting results in a tie for any position, the current officer staff will go into executive session and vote using a secret ballot to determine the winner. If a current member of the officer is involved in the tie, they will not participate in the secret ballot.
SECTION THREE FRAUDULENCE
If, for any reason it had been determined that there has been tampering with the balloting the Director shall invalidate the election and authorize another election following the procedures for elections.
SECTION FOUR TERMS OF OFFICE
The term of office for each elected officer position is one year from the date of election.
SECTION FIVE APPOINTED POSITIONS
The Director and Chief of Operations of FUEMS are appointed by the Director of Health Services to serve a one year term of office from the date of appointment. The Director of Health Services shall make this decision upon the recommendation of the previously elected and appointed Officer Staff. The appointment of the Director and Chief of Operations shall take place one month prior to the annual election of officers, that is, the first Tuesday of March of each year.
SECTION SIX MEETINGS
SUBSECTION A ANNUAL MEETINGS
There shall be an annual meeting of the Organization to be held on the first Tuesday of April each year. This is the annualelection.
SUBSECTION B ORGANIZATIONAL MEETINGS
There shall be at least 4 organizational meetings, in addition to the annual meeting, each academic year to update members on current FUEMS affairs.
SUBSECTION C OFFICER MEETINGS
The Medical Officers must meet at least once weekly at a time and place designated by the Chief of Operations, to discuss operational matters. TheChief of Operations shall Chair these meetings. The Director or a designate should attend these meetings to which all members should be welcome.
The Administrative Officers must meet at least once weekly at a time and place designated by the Director, to discuss administrative matters. The Director shall Chair these meetings. The Chief of Operations or a designate should attend these meetings to which all members should be welcome.
The Officer Staff must meet at least twice monthly at a time and place designated by the Chief of Operations and the Director, to discuss organizational matters. The Chief of Operations and the Director shall co-Chair these meetings. The entire membership is welcome to attend Joint Staff meetings.
SUBSECTION D EMERGENCY MEETINGS
The Chief of Operations or the Director may call an emergency meeting at any time to discuss any matter relating to FUEMS and should make all attempts to notify the members of such a meeting.
SUBSECTION E EXECUTIVE SESSION
The Chief of Operations may call the Medical Officer Meeting into Executive Session, at which time the meeting will be closed to any individual the Chief of Operations may wish to exclude from the meeting.
The Director may call the Administrative Officer Meeting into Executive Session, at which time the meeting will be closed to any individual the Director may with to exclude from the meeting.
The Chief of Operations or the Director may call the Joint Staff meeting into Executive Session, at which time the meeting will be closed to any individual the Chief of Operations or the Director may wish to exclude from the meeting.
SUBSECTION F ROBERT’S RULES OF ORDER
All meetings of the Organization should follow Robert’s Rules of Order.
SUBSECTION G MINUTES OF MEETINGS
Minutes of all meetings must be recorded and distributed to all appropriate individuals.
ARTICLE ELEVEN
SEPARATIONS AND VACATIONS
SECTION ONE SEPARATIONS
SUBSECTION A LEAVE OF ABSENCE STATUS AND PROCEDURE
A member may request a leave of absence (L.O.A.) from the Organization for any reason. This request should be made in writing to the Director and is subject to the Director’s approval. A L.O.A. releases a member from all duties and responsibilities as a member of FUEMS L.O.A.’s may not exceed one semester’s time. If a member does not request reinstatement at the conclusion of the leave he/she shall be dismissed from the Organization and notified in writing by the Director. If the member wishes to be reinstated at the conclusion of the leave, he/she shall submit a request in writing to the Director and is subject to the Director’s Approval.
SUBSECTION B WITHDRAWAL OR RESIGNATION
Any member may withdraw or resign from the Organization at any time for any reason. The member must do so in writing to the Director, stating the reasons for withdrawal or resignation.
SECTION TWO OFFICER VACANCIES
SUBSECTION A LINE OFFICER VACANCIES
In the event of a vacancy in any line officer position with the exception of the Chief of Operations position, the Chief of Operations shall appoint an interim officer, who must meet all qualifications of the position to which the interim officer is appointed, be from the membership, and have the approval of the Director. The interim officer shall have all command rights, duties and responsibilities as set forth herein for the position being filled. The interim officer shall serve until such time as an election can be held. The Director shall decide whether an election other than the annual election must be held.
SUBSECTION B CHIEF OF OPERATIONS VACANCY
In the event of a vacancy of the Office of the Chief of Operations, the Director of Health Services shall follow the normal procedure for the appointment of the Chief of Operations in consultation with the Director.
SUBSECTION C ADMINISTRATIVE OFFICER VACANCIES
In the event of a vacancy of any Administrative Officer position with the exception of the Director, the Director will appoint an interim officer as specified in Subsection A above.
SUBSECTION D DIRECTOR VACANCY
The Director of Health Services for the University shall fill a vacancy in the Director position following the normal procedure for the appointment of the Director in consultation with the Chief of Operations.
ARTICLE TWELVE
OFFICE
SECTION ONE NAME OF OFFICE
The office shall be referred to as Headquarters.
SECTION TWO DEFINITION OF NEED AND PURPOSE OF OFFICE
In accordance with University policies governing the assignment of office space and use of their facilities, the Organization shall maintain a sufficient office space necessary for operations. The Director shall have control over the office space with relation to access, maintenance and all usage. The Director must provide adequate space and access to the Chief of Operations for emergency medical operations.
ARTICLE THIRTEEN
TERMINATION OF THE ORGANIZATION
SECTION ONE STATE AUTHORITY OVER THE ORGANIZATION
The Organization’s certification as a New York State Registered Ambulance Service may be suspended, revoked, or annulled by the New York State Department of Health Emergency Medical Services Program. This may occur if medical operations fall short of state requirements or qualifications. The Chief of Operations must take efforts to ensure that such procedures never take place by obeying New York State Law regarding such a service.
SECTION TWO UNIVERSITY AUTHORITY OVER THE ORGANIZATION
The University may terminate the Organization at any time for any reason. However, in doing so it must be aware and accept the ramifications of such action and the effect it may have on the community. The Director must make every effort to ensure that such procedures never take place by obeying University Policy regarding the Organization.
SECTION THREE ORGANIZATIONAL AUTHORITY REGARDING TERMINATION
The Organization may decide to terminate itself by securing a 2/3 majority vote in favor of such action to be made by sealed ballot and to be counted by the Dean of Student Life in the presence of the Administrative and Medical Staffs with two other uninvolved witnesses selected by the Dean of Student Life.
SECTION FOUR IMPLEMENTATION OF TERMINATION DECISION
The Director must notify in writing the President of the University and the appropriate state agencies regarding the termination of the Organization. All persons affiliated with the Organization should be notified of such a decision.
ARTICLE FOURTEEN
AMENDMENT PROCESS
SECTION ONE AMENDMENT PROCESS
Any member of the Organization may propose to the Director, in writing, an amendment to these By-Laws and Constitution, detailing the reason for such a proposal. The Director shall bring the proposed amendment to a meeting of the Medical and Administrative Staffs for review. The Officers present shall decide by a consensus whether to bring the proposed amendment to the membership for consideration. If a majority vote among the Officer Corps. is affirmative, the Director will take the proposed amendment to the next regularly scheduled organizational meeting. A ¾ majority vote of the entire active membership will be necessary to amend any provision of these By-Laws and Constitution.
SECTION TWO IMPLEMENTATION OF AMENDMENT DECISION
Amendments that have undergone and passed this procedure shall become a part of these By-Laws and Constitution and must be recognized as such. Revised copies must be made and distributed appropriately upon completion of this process.
