Family Medical Leave Act
Family Medical Leave Act (FMLA) requires that an eligible employee must be granted up to a total of 12 weeks of unpaid leave during a rolling 12-month period for the following reasons:
· To take a medical leave when the employee is unable to work because of a serious health condition.
· The birth or adoption of a child, or the foster care placement of a child.
· To care for a spouse, child or parent who has a serious health condition.
During the leave an employee is entitled to job protection and the retention of health benefits. Upon return from the leave an employee must be reinstated to his or her former or equivalent position.
