PROPOSED DURATION OF STATUS RULE

Many in our International community are expressing concern over the DHS proposed rule to eliminate duration of status (D/S) for F students and their dependents, J exchange visitors and their dependents, and I media representatives which was published in the Federal Register on Friday, September 25, 2020.

Please be aware that this is a PROPOSED RULE, it is NOT NEW ACTIVE REGULATION to follow. Also, there is strong advocacy movement to defeat or ameliorate the impact of this draconian proposed rule. We will keep you informed as we go forward.

For now, if you wish, you could review the proposed rule published at 85 FR 60526 (September 25, 2020):

Please rest assured that OIS’ analysis of and position on the Department of Homeland Security's proposal to end D/S, among other changes, would be very damaging to international education as we know it.

This proposal is beyond eliminating D/S. It also introducing:

  • Date-Specific admission of F and J nonimmigrants
  • Identifying groups and institutions subject to a limited 2-year admission instead of a 4-year admission.
  • Reducing the F-1 "grace period" from 60 days to 30 days
  • New and drastic academic-related restrictions
  • New employment filing dates and the extension of stay process

Again – all of this is PROPOSED, NOT ACTIVE OR CURRENTLY IMPLEMENTED.
